Are ADUs legal in Florida?
It depends on the city. Florida has no statewide ADU mandate as of 2026. SB 48, which would have required every city and county to allow ADUs, passed the Senate 38 to 0 in February 2026 but died in the House on March 13, 2026. Many cities, including Tampa, allow ADUs under local rules.
